EIT Benefit Funds - Board of Trustees
The Plan Trustees who authorize the plans' benefits also have authority to:
  • Resolve questions concerning the plans
  • Make rules to implement the plans
  • Construe plan terms
  • Determine when plan benefits will be paid
Although the Trustees intend to continue the plans indefinitely, the Trustees reserve the right to amend or end any of the plans at any time for any reason. Changes may be made retroactively, if necessary, to qualify or maintain the benefits under the Internal Revenue Code or the Employee Retirement Income Security Act of 1974 (ERISA). The Trustees and the Fund Administrator have full discretion in determining any and all questions related to the plans, the funds or the operations of the plans. This discretion also applies to:
  • Any claim for benefits
  • The construction of the language or meaning of the rules and regulations adopted by the Trustees
  • The Summary Plan Descriptions of the plans
  • Any writing concerned with or provided in connection with the operation of the plan
The good faith decision of the Trustees or the Fund Administrator is binding upon anyone dealing with the plans or claiming benefit under the plans.
